From Facebook (http://www.facebook.com/legal/terms/):

For content that is covered by intellectual property rights, like photos

> Facebook (IP License). This IP License ends when you delete your IP content

They don't claim copyright to your photos, but they do claim the right to
use them for any purpose, including transfer to a third party for financial
gain.
