Leptochiton & genera names

There seems to be no restriction on the use of the same generic name for 
different types of organism, so long as they are in the different codes. 
Several birds have plant generic names,one springing to mind at 5.30 am is 
Glaucidium - a choice woodland plant genus, or an Old World owlet. But 
Phoebe is only a common name for certain North American birds, but a proper 
genus of  Asian Lauraceae. Phoenix is only a palm...
